a. bahwa Pengadaan Barang/Jasa Pemerintah yang efisien, terbuka dan kompetitif sangat diperlukan bagi ketersediaan Barang/Jasa yang terjangkau dan berkualitas, sehingga akan berdampak pada peningkatan pelayanan publik; b. bahwa untuk mewujudkan Pengadaan Barang/Jasa Pemerintah sebagaimana dimaksud pada huruf a, perlu pengaturan mengenai tata cara Pengadaan Barang/Jasa yang sederhana, jelas dan komprehensif, sesuai dengan tata kelola yang baik, sehingga dapat menjadi pengaturan yang efektif bagi para pihak yang terkait dengan Pengadaan Barang/Jasa Pemerintah; c. bahwa berdasarkan pertimbangan sebagaimana dimaksud pada huruf a dan huruf b, perlu menetapkan Peraturan Presiden tentang Pengadaan Barang/Jasa Pemerintah;
Dalam proses pengadaan barang/jasa pemerintah yang dilaksanakan secara kontraktual, tidak jarang terjadi ketidakpuasan Pejabat Pembuat Komitmen (PPK) atas pelaksanaan kontrak oleh penyedia barang/jasa. Ketidakpuasan tersebut dapat berujung pada pemutusan kontrak secara sepihak oleh Pejabat Pembuat Komitmen yang diikuti dengan tindakan lainnya seperti penagihan pengembalian uang muka secara penuh dan memasukkan penyedia barang/jasa dalam daftar hitam. Sementara pihak penyedia barang/jasa tidak akan menerima begitu saja tindakan pemutusan kontrak oleh PPK. Pihak penyedia barang/jasa akan berusaha untuk mengajukan berbagai alasan dan pembelaan. Dengan demikian pemutusan kontrak dapat menimbulkan sengketa di antara PPK dengan Penyedia Barang/Jasa. Pemerintah Indonesia melalui Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa Umum telah mengatur tata cara penyelesaian sengketa di antara para pihak yang berkontrak. Selain itu khusus untuk kontrak pengadaan barang/jasa pemerintah ketentuan tentang pemutusan kontrak dijumpai pula dalam Perpres nomor 54 tahun 2010. Penyelesaian sengketa dapat dilakukan dengan cara musyawarah di antara pihak yang bersengka, dan dapat pulah dilakukan dengan melelui jalur hukum di pengadilan. Task 2 • You have decided to undertake an investigation to see whether the journalist is right in alleging the FD has stolen any money. Your President is coming into the EMF offices in 20 minutes to discuss with you how you are going to manage the situation. • In your groups prepare a draft action plan on the next steps you are going to take to discuss with the EMF President.

This award recognises our combined efforts. Efforts which flow from the collective spirit of the OPCW in working towards a common good that serves all humanity. I feel deeply privileged to be able to address you on this occasion. I also take this opportunity to honour the memory of Nelson Mandela. Yet, this is the first time that the Peace Prize has been awarded to an organisation that is actively engaged in disarmament as a practical and ongoing reality. A task we have been carrying out with quiet determination, and no small measure of success. The Norwegian Nobel Committee awarded the 2005 Nobel Peace Prize to the IAEA and Director General ElBaradei in equal shares. The IAEA and its Director General won the 2005 Peace Prize “for their efforts to prevent nuclear energy from being used for military purposes and to ensure that nuclear energy for peaceful purposes is used in the safest possible way”. The IAEA Board of Governors subsequently decided that the IAEA’s share of the prestigious prize would be used to create a special fund for fellowships and training to improve cancer control and childhood nutrition in the developing world. This fund is known as the “IAEA Nobel Peace Prize Cancer and Nutrition Fund”. The money will be dedicated to enhancing human resources in developing regions of the world for improved cancer control and childhood nutrition. In the area of cancer control, the money will be spent on establishing regional cancer training institutes for the training of new doctors, medical physicists and technologists in radiation oncology to improve cancer treatment and care, as part of the IAEA´s Programme of Action for Cancer Therapy (PACT). In the realm of nutrition, the focus of the Fund will be on capacity building in the use of nuclear techniques to develop interventions to contribute to improved nutrition and health for children in the developing world. Fund-supported fellowship awards will target young professionals, especially women, from Member States, through the IAEA’s Technical Cooperation (TC) Programme. Alongside such awards, regional events will be organized in Africa, Asia and Latin America in cancer control and nutrition during 2006. The IAEA Secretariat is encouraging Member States and donors to contribute to the IAEA Nobel Peace Prize Cancer and Nutrition Fund by providing additional resources, in cash and in-kind.
