PENYELESAIAN SENGKETA KONTRAK PENGADAAN BARANG ...

Dalam proses pengadaan barang/jasa pemerintah yang dilaksanakan secara kontraktual, tidak jarang terjadi ketidakpuasan Pejabat Pembuat Komitmen (PPK) atas pelaksanaan kontrak oleh penyedia barang/jasa. Ketidakpuasan tersebut dapat berujung pada pemutusan kontrak secara sepihak oleh Pejabat Pembuat Komitmen yang diikuti dengan tindakan lainnya seperti penagihan pengembalian uang muka secara penuh dan memasukkan penyedia barang/jasa dalam daftar hitam. Sementara pihak penyedia barang/jasa tidak akan menerima begitu saja tindakan pemutusan kontrak oleh PPK. Pihak penyedia barang/jasa akan berusaha untuk mengajukan berbagai alasan dan pembelaan. Dengan demikian pemutusan kontrak dapat menimbulkan sengketa di antara PPK dengan Penyedia Barang/Jasa. Pemerintah Indonesia melalui Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa Umum telah mengatur tata cara penyelesaian sengketa di antara para pihak yang berkontrak. Selain itu khusus untuk kontrak pengadaan barang/jasa pemerintah ketentuan tentang pemutusan kontrak dijumpai pula dalam Perpres nomor 54 tahun 2010. Penyelesaian sengketa dapat dilakukan dengan cara musyawarah di antara pihak yang bersengka, dan dapat pulah dilakukan dengan melelui jalur hukum di pengadilan. Tulisan ini mencoba membahas kelebihan dan kekurang dari cara penyelesaian sengketa tersebut.

ARRA Opportunity: DOE Workforce Training for the Electric Power Sector September 22, 2009 The U.S. Department of Energy (DOE) has just announced a funding opportunity utilizing funds under the American Recovery and Reinvestment Act (ARRA) to facilitate the development of a well-trained, highly-skilled workforce for the electric power sector to help implement the smart electricity grid. An opportunity for universities and colleges, including community colleges, to develop the next-generation electric power workforce is included as the STEPS (Strategic Training and Educating in Power Systems) program. Funding: DOE plans to make available up to $100 million for two initiatives – Topic A: Developing and Enhancing Workforce Training Programs for the Electric Power Sector ($35 to $40 million); and Topic B: Smart Grid Workforce Training ($60 to $65 million). Apprenticeship Training Models Leveraging EPCE online courses to make apprentice training more efficient and improve the apprentices’ learning experience The retirement bubble is coming—a large percentage of the energy workforce is slated for retirement within the next few years, which will leave a critical employment gap. This gap will have a negative impact on utilities’ ability to meet the demands of the work. The 21st century economy demands a workforce with some degree of post-secondary education and the adaptability to respond immediately to changing situations. EPCE is playing a lead role in meeting these demands by implementing apprenticeship training models that use online Electric Power Technology courses to meet specific training needs within approved apprenticeship training programs.
