EVALUASI PENAWARAN DALAM PROSES PEMILIHAN PENYEDIA ...

Balai Diklat Keuangan Palembang Hal yang paling berpengaruh dalam proses pemilihan penyedia barang/jasa pemerintah adalah evaluasi penawaran. Proses evaluasi penawaran dilakukan oleh Kelompok Kerja ULP atau Panitia Pemilihan Penyedia Barang/Jasa Pemerintah dengan cara meneliti dan menilai dokumen penawaran yang disampaikan oleh peserta lelang. Evaluasi bertujuan untuk menentukan penyedia yang akan menjadi pemenang, pemenang cadangan I, dan pemenang cadangan II. Evaluasi dilaksanakan dengan cara yang telah ditetapkan dalam Peraturan Presiden nomor 54 tahun 2010 yang telah direvisi dengan Peraturan Presiden nomor 70 tahun 2012 tentang Perubahan Kedua Atas Peraturan Presiden nomor 54 Tahun 2010 tentang Pengadaan Barang/Jasa Pemerintah, dan Peraturan Kepala Lembaga Kebijakan Pengadaan Barang dan Jasa Pemerintah (LKPP) nomor 14 tahun 2012 tentang Petunjuk Teknis Peraturan Presiden nomor 70 Tahun 2012 tentang Perubahan Kedua Atas Peraturan Presiden nomor 54 Tahun 2010 tentang Pengadaan Barang/Jasa Pemerintah. Pentingnya evaluasi penawaran dalam rangkaian proses lelang karena hasil evaluasi penawaran tersebut dijadikan dasar untuk menetapkan pemenang lelang. Kesalahan dalam melaksanakan penilaian terhadap dokumen penawaran akan berakibat kekeliruan dalam menetapkan pemenang lelang. Kekeliruan tersebut selain dapat menyebabkan buruknya kinerja/kualitas barang yang diperoleh dan/atau tingginya harga yang harus dibayarkan, juga dapat menimbulkan kerugian negara. Objek penilaian meliputi persyaratan administrasi, persyaratan teknis, dan penawaran biaya, serta persyaratan kualifikasi penyedia. Untuk mengetahui bagaimana cara menilai setiap objek penilaian tersebut serta dokumen apa saja yang dipersyaratkan akan diuraikan dalam tulisan berikut ini.

Pengadaan Barang/Jasa Pemerintah dengan cara Pengadaan Langsung dilakukan oleh Pejabat Pengadaan dengan cara membeli barang atau membayar jasa secara langsung kepada penyedia barang/jasa, tanpa melalui proses lelang atau seleksi. Pengadaan langsung pada hakikatnya merupakan jual beli biasa dimana antara penyedia yang memiliki barang/jasa untuk dijual dan Pejabat Pengadaan yang membutuhkan barang/jasa terdapat kesepakatan untuk melakukan transaksi jual-beli barang/jasa dengan harga yang tertentu. Peraturan Presiden nomor 54 tahun 2010 dan Peraturan Presiden nomor 70 tahun 2012 telah menetapkan beberapa persyaratan penyedia barang/jasa pemerintah. Namun dalam hal pengadaan barang dan jasa lainnya dilaksanakan dengan cara pengadaan langsung Pejabat Pengadaan diperkenankan untuk membeli barang/jasa kepada penyedia yang tidak memenuhi syarat sebagai penyedia barang/jasa. Tanggal 31 Juli 2012 Pemerintah menerbitkan Praturan Presiden nomotr 70 tahun 2012 tentang Perubahan Kedua Atas Peraturan Presiden Nomor 54 Tahun 2010 Tentang Pengadaan Barang/Jasa Pemerintah. Perubahan atas Peraturan Presiden nomor nomor 54 tahun 2010 tersebut ditujukan sebagai upaya pemerintah untuk mempercepat jalannya pelaksanaan pembangunan melalui percepatan pencairan anggaran belanja negara. Peraturan Presiden nomor 70 tahun 2012 merupakan perubahan kedua atas Peraturan Presiden nomor 54 tahun 2010, perubahan kesatu telah dilakukan dengan Peraturan Presiden nomor 35 tahun 2011. Peraturan Presiden nomor 70 tahun 2012 bukan merupakan pengganti Peraturan Presiden nomor 54 tahun 2010 melainkan hanya merubah bagian-bagian tertentu dari Peraturan Presiden nomor 54 tahun 2010. Dengan demikian seluruh ketentuan yang terdapat dalam Peraturan Presiden nomor 54 tahun 2010 yang tidak termasuk dalam Peraturan Presiden nomor 70 tahun 2012 masih tetap berlaku.

PENYELESAIAN SENGKETA KONTRAK PENGADAAN BARANG ...

Dalam proses pengadaan barang/jasa pemerintah yang dilaksanakan secara kontraktual, tidak jarang terjadi ketidakpuasan Pejabat Pembuat Komitmen (PPK) atas pelaksanaan kontrak oleh penyedia barang/jasa. Ketidakpuasan tersebut dapat berujung pada pemutusan kontrak secara sepihak oleh Pejabat Pembuat Komitmen yang diikuti dengan tindakan lainnya seperti penagihan pengembalian uang muka secara penuh dan memasukkan penyedia barang/jasa dalam daftar hitam. Sementara pihak penyedia barang/jasa tidak akan menerima begitu saja tindakan pemutusan kontrak oleh PPK. Pihak penyedia barang/jasa akan berusaha untuk mengajukan berbagai alasan dan pembelaan. Dengan demikian pemutusan kontrak dapat menimbulkan sengketa di antara PPK dengan Penyedia Barang/Jasa. Pemerintah Indonesia melalui Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa Umum telah mengatur tata cara penyelesaian sengketa di antara para pihak yang berkontrak. Selain itu khusus untuk kontrak pengadaan barang/jasa pemerintah ketentuan tentang pemutusan kontrak dijumpai pula dalam Perpres nomor 54 tahun 2010. Penyelesaian sengketa dapat dilakukan dengan cara musyawarah di antara pihak yang bersengka, dan dapat pulah dilakukan dengan melelui jalur hukum di pengadilan. Tulisan ini mencoba membahas kelebihan dan kekurang dari cara penyelesaian sengketa tersebut.
